PURCHASES & TRANSACTIONS

Limited Warranty

Springfield Special Products limited warranty includes The Blob®, The Wave Whirl, Water Slides, and other vinyl products.

Please note that these products when used in a commercial environment are bound by limited One-year warranty.

The Limited Warranty set forth below is given by SSP Acquisitions, Inc. dba Springfield Special Products with respect to product(s) purchased and used in the United States and Canada.

All reinforced PVC Products have a Limited Warranty against manufacturer’s defects in material and workmanship, so long as the products remain in the possession of the original owner. The Limited Warranty for our Reinforced PVC Products is up to (5) years; this may vary depending on use and other conditions. What is covered are the defects in the material or workmanship caused by the manufacturer. Any warranty repairs or replacements during the warranty period will be fully covered during the first two years of ownership and partially covered based on a depreciated replacement schedule for the remaining (3) three years at the depreciated replacement schedule equates to 20 percent decline in the replacement value per year.

When returning any product under this Limited Lifetime Warranty, you must first contact Springfield Special Products to obtain authorization. The product must be packaged with a complete explanation of problems. Shipping charges, if any, must be prepaid. Products covered by this Limited Warranty will be returned to you without charge by Springfield Special Products.

This Limited Warranty covers all defects encountered in normal use of the product and does NOT apply in the following cases:

1. Loss or damage due to abuse, mishandling, alterations, accidents.

2. Failure to follow operating, maintenance, or storage instructions.

3. Service by a party other than Springfield Special Products authorized personnel.

4. Any acts of God including storm or animal damage.

5. The product has had its dates altered.

6. Normal wear and tear which includes sun damage and other normal weathering of the products

No implied warranty (or condition), including any implied warranty (or condition) of merchantability or fitness for purpose, applies to the product alter the application period of express warranty stated above, and no other express warranty or guaranty mentioned above, given by any person, firm, or corporation with respect to the products stated above. Some states or provinces do not allow limitations on how long an implied warranty lasts, the above limitations may not apply to you.

Springfield Special Products shall not be liable for loss of revenue or profit, failure to realize savings or other benefits, or for any other special, incidental or consequential damages caused by the use or misuse or inability to use the product regardless of legal theory on which the claim is based, and even if Springfield Special Products has been advised of possibility of such damages. Nor shall recover any kind against Springfield Special Products be greater in amount than the purchase price of the product sold by Springfield Special Products and causing the alleged damage.

Without limiting the foregoing, you assume all risk and liability for loss, damage or injury to you and your property and to others and their property arising out of the use, misuse, or inability to use any product sold by Springfield Special Products not caused directly by negligence of Springfield Special Products. Some states or provinces do not allow exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. This Limited Warranty shall not extend to anyone other than the original purchaser of any product, or the person for whom it was purchased as a gift.

This Limited Warranty gives you specific legal rights. To the extent that such rights cannot be disclaimed under applicable law, this limited warranty does not affect such rights.

Limited Thirty (30) Day Warranty

The Limited 30-Day warranty set forth below is given by SSP Acquisitions, Inc., dba Springfield Special Products with respect to product(s) purchased and used in the United States and Canada.

Springfield Special Products product(s), when delivered to you in a new condition are warranted against defects in material or workmanship for a period of (30) days from the date or original purchase.  Defective product(s) returned to Springfield Special Products and proven to be defective upon inspection, will be repaired or exchanged for new product(s) or part(s) at a prorated value where applicable.

The warranty period for replacement products shall begin upon shipment of the same, but shall in no event after the warranty period of the defective product.
